It looks like we’ll be talking about Fiddy’s junk for a while yet
Back in September, 50 Cent sued Angela Kogan, the owner of a Perfection Plastic Surgery and MedSpa, accusing her of defamation for insinuating that he used her company’s services for an “enlargement procedure”.
This goes back to a picture Fiddy took with her back in 2020, assuming that she was just another fan. But then that photo appeared on the social media feed of Perfection Plastic Surgery and MedSpa. Because the photo was used for the company, Fiddy says that Kogan was implying that Fiddy was a client. And when the photo showed up on a gossip site called The Shade Room–complete with Kogan talking about the increase in enhancements–people (says Fiddy) assumed he had such surgery and was endorsing Kogan’s practice.
Kogan says that the photo was taken in her office when Fiddy and his girlfriend received some free spa treatments. Nothing more. The photo was “payment” from a normal, run-of-the-mill-nothing-to-see-here spa day. She moved to have the lawsuit dismissed.
However, a judge this week says that Fiddy’s claims are strong enough for the case to continue. I quote:
“They weakly argue that Jackson consented to the photo’s being uploaded on to Instagram while making no mention of Jackson’s consent/non-consent as to the screen capture video and the promotional value it doubtlessly served”, the judge wrote in his ruling.
“That omission is fatal”, he went on. “Because the defendants took it upon themselves to post the video onto their Instagram accounts, Jackson can plausibly argue that the defendants unauthorisedly used his likeness to promote their business regardless of whether the defendants had any role in TSR’s publication of either the tweet or the article.”
The whole thing is a step closer to going to trial. And so far, the advantage seems to be on Fiddy’s side.
