Pay-for-Play is Alive and Well in the US

Payola, the practice of paying to have a song played on the radio, has long been illegal. While non-existent in Canada–in all my years, I’ve never been offered or heard of anyone being offered money for adding a song to a station’s playlist–the concept is alive and well in the US, despite many attempts to stamp it out.

Why is it illegal? The thinking is that radio play can be a ticket to a song and artist becoming popular, resulting in great oodles of cash through sales. Tipping the scales in favour of one song over another with the promise of money (or hookers or blow or a car or whatever) is unfair and unethical and therefore illegal. It’s been this way since the late 50s.

Still, there are ways around it. A radio station can take money for playing a song if they make a clear announcement that the song’s play is sponsored. It’s like saying “Our playing of this song is a commercial for this artist and recording. Yep, we took money for it, but think of it as a commercial that runs three minutes and 49 seconds. Please enjoy.”

This brings me to an email I receive from an American PR company. Holy shit.
